• You must be at least 18 years old (or have parental consent) to use our services.
• You agree to use MerchFans only for lawful purposes and in compliance with all local and applicable laws.
• MerchFans reserves the right to suspend or terminate accounts that violate these Terms.

• When you create a store or sell products, you are responsible for the accuracy of your content, branding, and product listings.
• You retain ownership of your designs, but grant MerchFans a license to use them as needed to manufacture, promote, and fulfill your products.
• You may not upload content that infringes on intellectual property rights, promotes hate, or violates community standards.

• When MerchFans provides white-glove or managed services, including but not limited to the creation of designs, product concepts, or marketing assets, those deliverables remain the intellectual property of MerchFans.
• Even if such deliverables incorporate your brand identity or intellectual property, you receive only a limited license to use them within your MerchFans store.
• MerchFans is not required to provide editable source files, artwork, or design assets, unless otherwise agreed in writing.

• All payments are processed securely through trusted third-party providers.
• MerchFans handles manufacturing and fulfillment for on-demand items; delivery times may vary.
• Clients may also send finished products to our fulfillment locations. MerchFans reserves the right to notify clients with 30 days’ notice that stock items must be removed, and to provide an address for return shipment.
  • If no response is received within the notice period, MerchFans reserves the right to discard any remaining client inventory. Disposal and handling charges may apply.
• Returns and refunds are handled in accordance with our official Refund Policy.

Self-Managed Stores (Creator-Managed):

• Clients are responsible for setting up their own payment information and ensuring payment for orders before production begins.
• Profits from sales will be transferred to the client’s provided bank account, minus costs of goods sold (COGS), shipping fees, processing fees, and applicable taxes.
• Payouts are issued after the sale of an order has been processed.

MerchFans-Managed Stores (White-Glove Service):

• MerchFans will pay for all upfront fees (COGS, shipping, and taxes).
• Profits will be transferred to the client’s bank account on the 15th day of the following month for sales completed in the prior month.

MerchFans Intellectual Property:

• All content, features, and functionality available through MerchFans – including but not limited to the logo, platform design, software, graphics, text, product images, and underlying technology -are the exclusive property of MerchFans and are protected.
• You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any part of the MerchFans platform or services without prior written consent from MerchFans.
• You agree not to reverse engineer, decompile, or otherwise attempt to access the source code of the MerchFans platform or any software used to provide our services.
• Except for the limited rights granted to you to use the platform in. accordance with these
• Terms, no license or rights are transferred to you under any intellectual property law.
• MerchFans reserves all rights not expressly granted in these Terms.

Creator Intellectual Property:

• Creators retain ownership of their own original designs, artwork, logos, and branding uploaded to MerchFans for the purposes of creating merchandise.
• By uploading content, you grant MerchFans a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute your designs solely for the purpose of manufacturing, promoting, and fulfilling your products.

White-Glove & Managed Services:

• When MerchFans provides white-glove or managed services, including the creation of designs, product concepts, or marketing assets, those deliverables remain the intellectual property of MerchFans.
• Even if such deliverables incorporate your brand elements, logos, or intellectual property, you are granted only a limited license to use the final products within your MerchFans store.
• MerchFans is not required to provide editable source files, raw artwork, or design assets, unless otherwise agreed in writing.

• To the maximum extent permitted by law, MerchFans, its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising out of or in connection with your use of the MerchFans platform, whether based in contract, tort, negligence, strict liability, or otherwise, even if MerchFans has been advised of the possibility of such damages.
• MerchFans makes every effort to keep the platform secure, reliable, and available, but we do not warrant that the platform will be uninterrupted, error-free, or free of harmful components such as viruses or malware. Access to the platform may be temporarily suspended without notice due to maintenance, technical issues, or circumstances beyond our control.
• Your sole and exclusive remedy for dissatisfaction with the platform, services, or these Terms is to discontinue your use of MerchFans.
• In no event shall MerchFans’ total cumulative liability to you for any claims arising out of or related to the platform exceed the greater of: (i) the total fees you have paid to MerchFans in the twelve (12) months preceding the claim, or (ii) one hundred U.S. dollars ($100).

Force Majeure:
MerchFans shall not be liable or responsible for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, strikes, labor disputes, government actions, internet or telecommunications failures, service provider interruptions, or other events of force majeure.

• We may update these Terms from time to time. Updates will be posted here with a revised “Effective Date.” Continued use of MerchFans after updates means you accept the new Terms.
